Disclosure, Campaign Statements and Ethics

The Political Reform Act of 1974 requires public officials to disclose assets and income that may be materially affected by their official actions. The Act requires governmental agencies to ensure that their public officials (council, board, and commission members, employees, and consultants) disclose their interests on or before the statutory deadlines. The City Clerk is the Official Filing Officer for the City of Rohnert Park. The City Clerk is responsible for the collection, maintenance, and protection of filing and disclosure documents. Additionally, the City Clerk is responsible for ensuring public access to these materials as prescribed by the California Fair Political Practices Commission (FPPC).

City Councilmembers are elected officers identified in Government Code section 87200 and are required to file Statements of Economic Interest forms (Form 700) with the City Clerk's Office. Copies of the statements filed by the City Council may be obtained by visiting the webpage of the Fair Political Practices Commission .  Copies of the statements filed by the City Council, City commission, committees, and boards, City employees, and consultants can also be obtained by contacting the  City Clerk’s Office .

In addition, State law requires the filing of campaign disclosure statements by local candidates for elective office, elected officeholders, and committees supporting or opposing local candidates or ballot measures. Conflict of Interest Filings

Form 700 – Statement of Economic Interests

As required by the Political Reform Act (Gov. Code, § 81000 et seq.), the City of Rohnert Park has adopted a conflict of interest code to designate which public officials must disclose their personal financial information on a Statement of Economic Interests, Form 700, so the public may review that information and be knowledgeable that the official is not using their decision making authority to affect their personal financial interests.

Government Code Section 87200 identifies City Council, City Manager, City Treasurer/Finance Director, City Attorney, and City Planning Commissioners as statutory filers who are required to file Statements of Economic Interests no later than April 1st of each year. City employees in classifications that are designated in the City’s conflict of interest code also file a Statement of Economic Interests Form 700. A Statement of Economic Interests Form 700 is also filed when the official takes office and leaves office.

Campaign Statement Filings

Local Campaign Filings – Online Posting (AB 2151 (Gallagher) – Chapter 214, Statutes of 2020.)

Beginning January 1, 2021, this law requires local government agencies to post campaign statements and reports on their agency’s website, within 72 hours of each applicable filing deadline, if they are filed in paper format. If the final day of the 72-hour period is a Saturday, Sunday, or holiday, the period is extended to the next day that is not a Saturday, Sunday, or holiday.

Before posting, the local filing officer shall redact the street name and building number of the persons or entity representatives listed on any statement, report, or document, or any bank account number required to be disclosed by the filer. Providing a link on the agency’s internet website to the statement, report, or other document satisfies this requirement.

This bill further requires that the statements and reports be made available for four years from the date of the election associated with the filing.

Tickets to Agency Policy (Form 802)

The City of Rohnert Park has adopted a Ticket Distribution Policy in response to distribution regulations as set forth by the Fair Political Practices Commission (FPPC) in Section 18944.1 of the California Code of Regulations. Form 802 is used by local government agencies to disclose the distribution (to an agency official) of tickets or passes that allow admission to facilities, events, shows or performances for entertainment, amusement, recreational, or similar purposes.

The policy and filed forms are required to be posted on the City’s web page for public inspection.

Agency Report of Public Officials Appointments (Form 806)

Form 806 is used to report additional compensation that officials receive when appointing themselves to positions on committees, boards or commissions of a public agency, special district, joint powers agency or authority.

Each agency must post on its website a single Form 806 which lists all the paid appointed positions. When there is a change in compensation or a new appointment, the Form 806 is updated to reflect the change.
